VA Funding Fee Refund: Which Effective Date Matters?

By The Housing Current Editorial TeamAugust 30, 20265 min read

Check which effective date supports a VA funding fee refund, what documents to gather, and where the money goes when you financed the fee.

A disability award issued after closing can support a VA funding fee refund. The key is the compensation effective date: it must be on or before the date the fee was collected, ordinarily at closing. A later decision date does not disqualify you, but a disability rating alone does not establish refund eligibility. VA must review how its timing rule applies to your loan. VA’s published legal interpretation

Separate the four dates in your file

Build a timeline before requesting a refund. Keep these dates separate even when two happen to match:

Date Where to look What it establishes
Disability decision date VA rating decision and notification When VA decided the claim
Compensation effective date Award and rating decision When the compensation award takes effect
Loan closing date Final Closing Disclosure and closing records When the loan closed
Funding fee collection date Closing records and lender confirmation When the fee was collected from you

VA’s June 25, 2019, General Counsel opinion identifies closing as the operative event when the funding fee is assessed and collected.

The lender’s later transfer of the fee to VA, called remittance, is a separate transaction. Federal regulations generally require remittance within 15 days after closing. That later transfer does not extend the eligibility window. If your records show different closing and collection dates, ask the lender and VA to reconcile them. 38 CFR 36.4313(e)

Also distinguish the compensation effective date from the start of payments. Federal law separately addresses when payment begins and when a person is deemed to receive benefits. Do not substitute the first bank deposit for the effective date in your award. 38 USC 5111

Does the effective date have to be before closing?

VA’s Loan Fees page, updated May 26, 2025, describes compensation effective before closing. The controlling precedent expressly includes compensation effective on the collection date. VA’s November 20, 2019, Federal Register notice explains that precedent opinions bind VA officials on the legal issues decided, subject to superseding authority. An award effective on the collection date therefore warrants review under that rule. Federal Register notice

Hypothetical example: You closed and paid the fee on June 15, 2026. VA issued a compensation award on August 10, effective June 1. That satisfies the precedent’s timing test. An effective date of June 15 also falls within the rule; June 16 does not establish a refund through that retroactive award alone. These are illustrations, not individual eligibility determinations. VAOPGCPREC 2-2019

Read the actual compensation award rather than relying on the date you filed a claim or a summary of your current rating. If you dispute the compensation effective date itself, consult a VA-accredited representative.

A proposed disability rating follows a different rule

A qualifying pre-discharge rating can establish a funding fee exemption before compensation payments begin. Under the statute, a qualifying pre-discharge examination and rating, or memorandum rating based on existing medical evidence, establishes the relevant status from the rating date—even without a compensation award effective that day. 38 USC 3729(c)(2)

That does not make a proposed rating received after closing equivalent to a retroactive compensation award. VA’s lender instructions say an active-duty service member who closes before discharge without the required proposed or memorandum rating is not entitled to a refund on that basis. Circular 26-23-19

If closing is still ahead, ask the lender to resolve exemption status now. VA instructs lenders not to advise borrowers to close with a promised refund later. Our mortgage program requirements and homebuying guides provide broader planning resources.

Assemble your VA funding fee documentation

Prepare a compact inquiry file. This suggested checklist helps organize your records; it does not establish what VA will require in your case:

  • Award evidence: The decision and notification showing compensation entitlement and its effective date. Include relevant earlier decisions if the history spans several awards.
  • Closing evidence: The final Closing Disclosure, funding fee amount, and records showing whether you paid cash or financed it.
  • Loan identification: Your VA loan number, property address, originating lender, current servicer, and recent mortgage statement.
  • Exemption history: The Certificate of Eligibility used for the loan, if available, and correspondence about a pending claim or exemption.

Make a one-page chronology with the four dates above and identify the document supporting each entry. If something is missing, note the record you need instead of filling the gap from memory.

Use the applicable form only when needed

VA Form 26-8937 verifies benefits in specified circumstances; it is not a universal borrower refund application. If your lender needs it, use the May 2025 edition, which expressly supersedes the June 2022 edition. The form displays an OMB expiration date of May 31, 2028. VA Form 26-8937

Request a review and document the response

Contact your mortgage holder or the VA Regional Loan Center at 877-827-3702. VA refund contact guidance

Ask VA to review the compensation effective date against the fee collection date and confirm the amount eligible for refund. Request a reference number, any missing-document instructions, and a follow-up date. If the request is denied, ask for the reason and the authority applied in writing.

For lenders and servicers, Circular 26-23-19 directs refund requests through the VA Funding Fee Payment System, with explanatory notes and supporting documents in WebLGY. The October 2, 2023, circular states that it remains valid until rescinded and expressly rescinds Circular 26-22-12. Lender refund procedures

Where a financed funding fee refund goes

For refunds issued on or after July 1, 2019, VA pays the veteran directly, regardless of the loan balance. The former instruction to apply a financed fee refund to outstanding principal no longer governs those refunds. VA’s payment-destination guidance

Receiving the refund does not itself reduce your mortgage balance. Keeping it preserves cash; sending it to the servicer as a principal payment reduces the balance. Before sending it, obtain instructions for applying it to principal and ask whether your required monthly payment would change. Continue following your existing payment instructions until the servicer confirms otherwise. Our guidance for existing homeowners offers related ownership resources.

Close the inquiry only after you can match the approved refund amount to the payment received. If you use the refund to pay down principal, also confirm that the servicer posted it correctly. Keep the approval, payment record, and any principal-payment confirmation with your mortgage documents.

Frequently asked questions

Can a VA disability award after closing qualify me for a refund?

It can, if the compensation award is effective on or before the funding fee collection date, ordinarily closing. A later decision date alone does not prevent a refund; VA must review how the rule applies to your loan. VA precedent

Does an effective date on the closing date count?

Yes, if the fee was collected that day. The precedent’s timing rule includes compensation effective on the collection date. Ask VA to review the award under that rule. Federal Register notice

Does a proposed rating received after closing establish refund eligibility?

It does not retroactively establish the pre-discharge rating exemption. VA’s circular specifically addresses service members who close before discharge without the required rating; distinguish that situation from a later retroactive compensation award. VA lender guidance

Does a financed funding fee refund automatically reduce my mortgage?

No. For qualifying refunds issued on or after July 1, 2019, VA pays the veteran directly, including when the fee was financed. You can separately arrange a principal payment with your servicer. VA refund guidance
