Rental LLC Mortgage Transfer Checklist

By The Housing Current Editorial TeamSeptember 19, 20263 min read

Before a rental LLC mortgage transfer, check investor rules, personal liability, occupancy terms and the requirements for a later refinance.

You may be able to transfer your mortgaged rental property to an LLC, but the deed alone does not release you from mortgage liability. Whether the loan permits the ownership change is a separate question. Fannie Mae’s transfer procedures distinguish an exempt ownership transfer from an assumption and release.

This checklist is for a rental owner whose existing loan is in an individual’s name. The Fannie Mae example below reflects guidance available on September 19, 2026.

Separate the deed from the debt

A deed conveys an ownership interest. An assumption addresses responsibility for the existing loan. A release of liability addresses whether the original borrower remains obligated. Under Fannie Mae’s transfer procedures, the recipient of an exempt transfer generally does not have to assume the mortgage unless the transaction involves a release of liability or a loan modification. Obtain a separate answer about any requested release; permission to change title does not supply one.

A due-on-sale, also called due-on-transfer, clause can let the lender demand repayment of the secured debt following an unauthorized transfer. That is a contractual option, subject to applicable exemptions, rather than automatic acceleration whenever a deed changes. Federal law’s listed protections for certain residential transfers do not expressly include a general LLC exemption. 12 U.S.C. §1701j-3.

Gather the signed note, mortgage or deed of trust, riders and amendments. Identify the transfer and occupancy provisions, including those for any second mortgage.

Identify the mortgage investor

The company collecting payments may service the loan for someone else. The CFPB recommends asking the servicer who owns the mortgage and points borrowers to Fannie Mae and Freddie Mac lookup tools.

Request the investor’s identity and the policy governing your proposed transfer. A familiar servicer name or a “conventional” loan label does not establish that Fannie Mae’s rule applies. For a portfolio loan or a debt-service-coverage-ratio (DSCR) loan, obtain the applicable contractual provision and investor requirements.

Check the Fannie Mae LLC transfer conditions

Fannie Mae’s LLC exemption requires these conditions:

Check Evidence to obtain
Fannie Mae purchased or securitized the mortgage on or after June 1, 2016. Written confirmation of that date. The borrower’s closing date is not the specified test.
The original borrower controls the LLC or owns a majority interest. Operating agreement, ownership schedule and management provisions showing how the proposed LLC meets either test.
Any permitted change to investment-property occupancy complies with the security instrument. Original occupancy terms and occupancy history. The guide cites a principal residence’s 12-month occupancy requirement as an example.

Membership alone does not establish control or majority ownership. Ask the servicer what evidence it needs.

For a qualifying exempt transfer without a requested release, Fannie Mae’s August 12, 2026 Servicing Guide directs the servicer to process it without reviewing or approving the transfer’s terms. Written confirmation of that treatment is a practical documentation step, not an added Fannie Mae underwriting condition.

Plan the later refinance

Fannie Mae requires servicers to tell borrowers that property transferred to an LLC must return to a natural person’s ownership to qualify for refinancing under its Selling Guide. That warning concerns Fannie Mae financing; it does not establish every lender’s LLC policy. Servicing Guide, D1-4.1-02.

For a Fannie Mae cash-out refinance, time held by a borrower-controlled or majority-owned LLC may count toward the six-month ownership requirement, but title must move to the individual borrower or borrowers before closing. Other eligibility rules still apply, including the generally applicable 12-month age requirement for an existing first mortgage being paid off. September 2, 2026 Selling Guide, B2-1.3-03.

Before incurring transfer costs, ask a prospective refinance lender to identify the sequence of title changes and documentation it would require.

Assemble the written record before recording

  • Servicer determination: Obtain a response identifying the loan, property and LLC, the exemption or required consent, outstanding conditions, and who remains liable.
  • Document and processing requirements: Confirm required entity documents, signatures, fees, any necessary mortgage-insurer approval, and the sequence for submitting and recording the deed. Keep the response with the deed draft.
  • Insurance and title review: Ask the property insurer and title professional to confirm how they will handle the proposed owner and existing lien. Fannie Mae separately requires servicers to notify relevant insurers, tax authorities and other interested parties when processing a transfer. Servicing Guide.
  • Cost and refinance plan: Obtain estimates for recording and title work, ask whether transfer taxes or reassessment apply, and account for any later transfer back to individual ownership.

For related coverage, see single-family rental ownership and mortgage servicing and ownership changes.

Have a local real estate attorney and tax professional review the proposed deed and jurisdiction-specific consequences. Postpone recording while investor identity, transfer treatment, occupancy compliance or personal liability remains unresolved.

Frequently asked questions

Does transferring the deed to my LLC remove me from the mortgage?

No. A deed transfer alone does not release the original borrower; obtain explicit documentation of any approved release. Fannie Mae treats ownership transfers, assumptions and releases separately in its transfer procedures.

Does the company collecting my mortgage payments own the loan?

Not necessarily. It may service the mortgage for another owner. Ask the servicer to identify the owner or investor before relying on an LLC transfer policy. The CFPB explains how to check mortgage ownership.

Does transferring title back from an LLC restart the refinance ownership period?

Not necessarily for a Fannie Mae cash-out refinance. Time held by a borrower-controlled or majority-owned LLC may count toward the six-month ownership requirement, but title must transfer to the individual borrower or borrowers before closing, and other eligibility rules still apply.
